you agree to be bound by these Terms. If you do not agree, please do not use Fintrackau.
1. Eligibility
You must be at least 18 years of age to use Fintrackau. By accessing or using our service, you confirm that you meet this requirement.
If you are under 18, you may not create an account or use the service.
2. Nature of Service — Not Financial Advice
Fintrackau is a financial management tool only. We are NOT a licensed financial advisor, accountant, or tax agent.
We are not an Australian Financial Services Licensee (AFSL) and are not regulated by the Australian Securities and Investments Commission (ASIC) as a financial services provider.
All AI-generated insights, categorisations, recommendations, and estimates provided by Fintrackau are for
informational purposes only and do not constitute financial advice, tax advice, or investment advice.
You should not act on any information provided by Fintrackau without first consulting a qualified financial advisor or accountant.
3. AI Insights Disclaimer
- AI-generated market insights (electricity plans, mobile plans, credit cards, etc.) are based on publicly available information and are refreshed periodically. They may not reflect the most current market pricing.
- AI categorisation of transactions is automated and may contain errors. You are responsible for reviewing and verifying all categories before relying on them for tax purposes.
- Estimated savings figures displayed within Fintrackau are illustrative only. Individual results vary significantly based on personal spending patterns, tax circumstances, and plan availability in your area.
4. Tax Deductions — User Responsibility
Fintrackau may suggest potential tax deductions based on ATO guidelines. However:
- You are solely responsible for verifying the eligibility of any deduction with a qualified accountant or tax agent before claiming it.
- Fintrackau does not guarantee the accuracy or completeness of any tax-related categorisation or suggestion.
- Fintrackau does not prepare, lodge, or review tax returns.
5. Subscription Terms
- Billing: Subscriptions are billed monthly or annually, as selected at the time of purchase, via Stripe.
- Free Trial: New accounts may be eligible for a 14-day free trial. No charge is made until the trial period ends.
- Cancellation: You may cancel your subscription at any time from the Billing page. Your access will continue until the end of the current billing period. No pro-rata refunds are provided for partial months unless required by law.
- Refunds: Refund requests are assessed on a case-by-case basis. Contact support@fintrackau.com within 7 days of a charge if you believe it was made in error.
- Price changes: We will provide at least 30 days notice before any price changes take effect.
6. Data Ownership
- You own your data. Transactions, receipts, and financial information you upload remain your property.
- You grant Fintrackau a limited, non-exclusive licence to process, store, and display your data solely for the purpose of providing the service to you.
- We do not sell your data to third parties. See our Privacy Policy for full details.
- Upon account closure, your account enters a 14-calendar-day grace period to allow recovery in the event of accidental closure. After 14 days, all personal data is permanently and irreversibly deleted. You may request immediate deletion at any time by contacting support@fintrackau.com.
7. Acceptable Use
You agree not to:
- Use Fintrackau for any unlawful purpose, including tax fraud or money laundering.
- Upload malicious files, scripts, or content.
- Attempt to reverse-engineer, scrape, or interfere with our systems.
- Share your account credentials with others.
8. Termination
Fintrackau reserves the right to suspend or terminate your account immediately and without prior notice if you breach these Terms,
particularly the Acceptable Use provisions in Section 7. We will notify you by email where reasonably practicable.
Upon termination, your right to access the service ceases immediately. Data deletion will follow the timeline set out in our Privacy Policy.
9. Limitation of Liability
To the maximum extent permitted by applicable law:
- Fintrackau is provided "as is" without warranties of any kind, express or implied.
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of Fintrackau, including but not limited to lost profits, tax penalties, or data loss.
- Our total liability to you for any claim arising out of or relating to these Terms or the service shall not exceed the total fees you paid to Fintrackau in the 12 months preceding the claim.
- Nothing in these Terms excludes liability that cannot be excluded under Australian Consumer Law.
10. Intellectual Property
All software, designs, trademarks, and content within Fintrackau (excluding your uploaded data) are owned by or licensed to Fintrackau.
You may not copy, reproduce, or distribute any part of the Fintrackau service without written permission.
11. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales.
12. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes at least 14 days before they take effect via email or a notice on the Fintrackau platform.
Continued use of Fintrackau after the effective date constitutes acceptance of the revised Terms.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction,
that provision shall be modified to the minimum extent necessary to make it enforceable.
The remaining provisions shall continue in full force and effect.
